4:45 p.m. ET | Closing out our discussions for Day One of WP 2024, NSBA was pleased to provide an update on the Corporate Transparency Act (CTA) and our efforts to protect Small Business from this unconstitutional law. Led by Tim Terry of Hartz Capital, Tim Opsitnik with NSBA's Board, as well as Todd McCracken and Reed Westcott with NSBA staff, attendees heard an update on our lawsuit against the U.S. Department of the Treasury and its Financial Crimes Enforcement Network (FinCEN). including the mechanics of NSBA's legal argument.

In a nutshell, FinCEN and Treasury are establishing a new database of Small Business owners under their authority to administer the CTA, which is searchable any time without a warrant or due cause. To make matters worse, large corporations, including many financial institutions, are not required to submit to the terms and conditions of the CTA.
Presenting a winning case in Federal Court earlier this year, NSBA argued this is a plain violation of the Fourth Amendment, which prohibits warrantless searches. Further solidifying our victory, the Federal Judge presiding over the case created an exemption in compliance requirements for NSBA members in good standing as of March 1, 2024, including a stay on filing beneficial ownership information (BOI) reports currently due under the present form of the CTA.
Despite a promise to comply with the ruling, an appeal by FinCEN and Treasury over this victory for NSBA and Small Business is currently pending; however, NSBA remains optimistic the ruling will stand, and the CTA will be revaluated for changes in its mechanisms and effects.

###
4:00 p.m. ET | Highly anticipated, NSBA President & CEO Todd McCracken welcomed Michael Negron of the National Economic Council for an exclusive discussion on the effects of small-business policy impacting the economy. NSBA and our WP 2024 attendees were grateful for the chance to present Mr. Negron with questions related to these policies contextualized with insights from our members, as well as our Priority Issues.
We're looking forward to continuing work with the White House, Congress, and entire administration to better improve small-business policy. Read more about NSBA's Priority Issues here.
