MARCH 11, 2026, Washington, D.C. – This week, Sen. Ed Markey (D-Mass.) introduced the Small Business Liberation Act 2.0, NSBA-supported legislation that would create a small-business exemption from Section 122 tariffs imposed by the administration. NSBA is endorsing the measure and urging Members of Congress to support this and any other provision to ease the tariff burden borne by the U.S. small-business community.  

 

Below is a statement from NSBA President and CEO Todd McCracken. 


 

“For the better part of a year now, small-business owners have been subject to increasing prices and economic unpredictability due to the imposition of various tariffs, and I applaud Sen. Markey for his leadership in working to provide a small-business exemption. 

 

“In the next week, we will be releasing a new economic report that highlights how these tariffs are impacting small firms: just three percent of small businesses say tariffs have positively impacted their business while nearly half say they have been negatively impacted. The majority of small businesses say they have incurred increased costs, and among those, 74 percent say those cost increases are due to tariffs.  

 

“By providing a specific small-business carve-out, this legislation simply puts us on a level playing field with the various larger firms that have already been granted such exemptions. I thank Sen. Markey for introducing this bill and encourage others to support his efforts.”
